Terms of Service
In force since October 18, 2026
These terms govern the use of the Draupix platform (draupix.com, the seller dashboard and the hosted shops) operated by Maxime Ethier, doing business as Draupix, in Joliette, Québec, Canada. By creating a shop or using a Draupix shop, you accept these terms. Sections 1 to 13 address sellers; section 14 addresses shop customers; sections 15 to 19 apply to everyone.
1. Seller account
- You must be 18 or older and run a genuine business, in your own name or on behalf of a business you are authorized to represent.
- Information given at sign-up must be accurate and kept up to date.
- You are responsible for keeping your password confidential and for everything done from your account.
2. Your shop and its content
You alone are responsible for the products you offer, their descriptions, photos, prices and availability, and for compliance with applicable laws: labelling, product safety, copyright and trademarks, required permits, sales taxes.
Prohibited: illegal or counterfeit goods, weapons, drugs and tobacco or vaping products, regulated medicines and health products without authorization, hateful or pornographic content or content that infringes the rights of others, and any product Stripe refuses to process. Draupix may remove content or suspend a shop that breaks these rules.
3. Sales to customers
Every sale made in your shop is a contract between you and the customer. Draupix is not a party to that contract and is neither the seller nor a reseller of your products. You handle preparation, shipping, after-sales service, returns, refunds and the warranties required by law, including Québec’s Consumer Protection Act and the equivalent laws where your customers live.
4. Payments through Stripe
- Payments are processed by Stripe through a Stripe Connect account opened in your name. You accept the Stripe Connected Account Agreement, including the Stripe Services Agreement.
- Amounts paid by your customers are paid out by Stripe directly to your bank account on Stripe’s schedule. Draupix does not hold customer funds.
- Payment disputes (chargebacks), fraud and refunds are your responsibility; Stripe may hold or deduct the corresponding amounts from your account.
- Stripe processing fees are added to the Draupix commission and collected by Stripe.
5. Draupix pricing
No set-up fee and no per-product fee. Draupix charges a commission on every paid sale (product subtotal, shipping and taxes included), collected automatically by Stripe at the time of payment. The commission is progressive by brackets, based on the sales volume of the current calendar month, or of the previous month if it was higher:
- $0 to $1,000: 10%;
- $1,000 to $3,000: 8%;
- $3,000 to $8,000: 6%;
- $8,000 to $20,000: 4%;
- above $20,000: 3%.
Each dollar is charged at the rate of its bracket, with no retroactive recalculation. A $100 monthly minimum applies: if the commissions of a calendar month do not reach $100, the difference is billed to you at month end. Launch offer: for every shop opened on or before December 31, 2026, the calendar month of sign-up is exempt from the minimum; commissions apply as usual.
Optional add-ons, billed monthly and cancellable at any time: private couriers (FedEx, UPS, Purolator, Canpar) at $19.99 per carrier or $59.99 for all of them; Xero and FreshBooks accounting connectors at $14.99 each. QuickBooks Online and Canada Post are included at no charge. Applicable taxes are added where required. All amounts are in Canadian dollars.
Draupix may change its prices with at least 30 days’ notice by email; you may close your shop before the change takes effect if the new pricing does not suit you.
6. Shipping
Shipping costs shown at checkout come from the carriers (Canada Post and, if you enable them, your own FedEx, UPS, Purolator or Canpar accounts) or from your flat rates. Live rates are supplied by the carriers; Draupix does not guarantee their accuracy and is not liable for transport delays, loss or damage. Use of your carrier accounts remains subject to those carriers’ terms.
7. Accounting integrations
If you connect QuickBooks Online, Xero or FreshBooks, Draupix creates in your company the customers, items, invoices, payments and credit memos matching your orders. You remain responsible for keeping your books and for their accuracy, for reviewing the entries created and for choosing tax codes. You can disconnect a software at any time; its access tokens are then deleted and revoked.
8. Availability and support
Draupix aims for 99.9% availability: shops are monitored continuously and common incidents are fixed automatically. Planned maintenance is announced in advance. This is a target, not a guarantee: interruptions may occur, in particular at our providers (hosting, Stripe, carriers). Support is by email at contact@draupix.com, with an answer within one business day.
9. Intellectual property
You keep all rights to the texts, images and trademarks you publish. You grant Draupix a non-exclusive, royalty-free, worldwide licence to host them, display them in your shop and in the Draupix shop directory, and reproduce them technically (backups, image formats) for as long as your shop exists. The platform, its templates, its code and the Draupix brand remain the property of Draupix.
10. Personal information
The processing of personal information is described in our Privacy Policy, which forms part of these terms. As a seller, you are responsible for complying with privacy laws regarding the customer data you receive, and for using it only to fulfil their orders and answer their requests, unless they give you separate consent.
11. Closure and termination
- You may close your shop at any time from your dashboard or by writing to us. Commissions owed and, where applicable, the minimum for the current month remain payable.
- Draupix may suspend or close a shop in case of serious breach: prohibited products, fraud, infringement of third-party rights, non-payment of amounts due, or a requirement of Stripe or of the law. Except in urgent cases, we notify you by email with a reasonable time to fix the situation.
- On closure, you may request an export of your products and orders. Shop data is deleted within 30 days, except for the records the law requires us to keep.
12. Warranties and liability
The platform is provided as is, with the reasonable care of a diligent provider. To the extent permitted by law, Draupix is not liable for lost profits, goodwill or data, nor for indirect damages, and its total liability to a seller is limited to the amounts that seller paid to Draupix in the twelve months preceding the event. Nothing in these terms excludes liability that the law does not allow to be excluded.
13. Indemnity
You agree to indemnify Draupix against any third-party claim arising from your products, your content, your business practices or your breach of these terms or of the law.
14. Shop customers
- The shop’s seller is your contracting party for every purchase; their contact details appear at the bottom of their shop. Draupix provides the technology and secure payment through Stripe.
- You agree to provide accurate information, to use a customer account only for yourself and to publish only honest reviews, free of unlawful content.
- Returns, refunds and warranties are the seller’s responsibility under applicable law. If you have a problem with a seller you cannot reach, write to us: we will forward your request.
- Your rights as a consumer, including those under Québec’s Consumer Protection Act, are not limited by these terms.
15. Acceptable use
You may not interfere with the operation of the platform, access other people’s accounts or data without authorization, bulk-extract shop content, send spam or bypass security measures.
16. Changes to these terms
Draupix may change these terms. Material changes are announced to sellers by email at least 30 days before they take effect. Using the platform after that date means you accept them; otherwise you may close your shop at no additional cost.
17. Governing law
These terms are governed by the laws of Québec and the laws of Canada applicable therein. Any dispute is submitted to the competent courts of the judicial district of Joliette, subject to the public-order rules that allow a consumer to sue in the courts of their home.
18. Language
These terms exist in French and in English. In case of discrepancy, the French version prevails. The parties have expressly requested that this document and related communications be available in both languages.
